The Purpose of the Terms of Service

The Purpose of the Terms of Service(or “Agreement”) is to define the rights, duties and responsibilities between the corporation (will be referred to as “Gretech”) and the users regarding the use of www.GOMTV.net and m.GOMTV.net (the “Services”).

Effect of and changes to the Terms of Service

• To use the 'Services', the user must first agree to the 'Agreement'. If the user does not agree to the 'Agreement', he or she cannot use the 'Services'.
• The Terms of Service can be found at the bottom of the www.GOMTV.net page and are displayed at the time of www.GOMTV.net member registration, exercising its effect with the following methods.
  • By clicking to accept or agree to the Terms of Service. This option is made available to you by Gretech in the user interface for any Service.
  • By actually using the 'Services'. In this case, you understand and agree that Gretech will treat your use of the Services as acceptance of the Terms from that point onwards.
• If (a) the user has not reached the legal age to make a valid agreement with Gretech, or (b) the user is legally not allowed to use 'Services' due to the laws of the U.S. or other countries (areas where the user is residing in or using the 'Services' in), the user cannot use the 'Services' and agree to the 'Agreement'.
• By visiting and/or using the Website and/or any of the Gretech Services, you signify that you have read, understand and agree to be bound by these Terms of Service ("Terms of Service" or "Agreement").
• Gretech reserves the right, at our sole discretion, to change, modify, add, or delete portions of these Terms of Service at any time without further notice. It will be regarded that the user has agreed to the revised Terms of Service if he or she continues to use the Services after the applied date of the revised Terms of Service.
• When changes are made to the Terms of Service, 'Gretech' will indicate at the bottom of this page the Terms of Service's effective date.
• If the user does not agree to the amended Agreement, he or she can request for termination. If the user does not express any disagreement against the amendment within the 7 days from the time of Agreement emendation and continues to use the Service, it will be considered that the user agrees to the amendment of the Agreement.
• GOM player included in the 'Services' contain separate documents that define the rights, duties and responsibilities between the GOM player and the users. If there are contradictions or conflicts between the contents of the documents and the Terms of Services, (regarding GOM player) the contents of the separate documents will take precedence.
• Gretech will not be held liable for damages occurred to the user who fails to observe the changes made to the Agreement.

Copyright and Intellectual Property Rights

• The user acknowledges and agrees that 'Gretech' owns copyright and intellectual property rights regarding 'Services' in all the countries where the rights are registered (and even in the countries where those rights are not registered).
• All copyright and intellectual property rights of the contents created by 'Gretech' in relation to the 'Services' are properties of 'Gretech'.
• The copyright and intellectual property rights of the contents related to the 'Services' that are offered by other companies are the properties of the companies providing the contents.
• Unless the user has been specifically permitted to do so in a separate agreement with 'Gretech', the user agrees not to modify, rent, lend, sell, distribute all the contents (all or parts of it) related to the 'Services' and cannot create a secondary content based on the contents.
• The user will continue to possess the copyright and intellectual property right of all the content submitted, notified or displayed by the user through or on the 'Services'.
• The user guarantees that all the created contents that were submitted, posted or displayed on or through the 'Services' by the user do not infringe upon the rights of others regarding copyright and intellectual property rights (disregards whether or not such right is registered and targets all the countries where such rights could exist) and will be responsible for all the conflicts rising from the issue.
• Unless the user has agreed otherwise in writing with 'Gretech', the user agrees that he or she is responsible for protecting and enforcing rights over the content created by the user and that 'Gretech' has no obligation to protect such rights on behalf of the user.

Suspension / Discontinuation

Gretech may change or discontinue, temporarily or permanently, some or all of the GOMTV.net Services at any time, including the availability of any site feature, database, or content with or without prior notice. You agree that Gretech may do so at Gretech’s sole discretion. If you are a GOMTV ticket holder and Gretech suspends or discontinues the service, Gretech may, at its sole discretion, provide you with a credit, refund, discount or other form of compensation. However, if Gretech terminates your account, suspends or discontinues your access to GOMTV service due to your violation of the Terms of Service, you will not be eligible for any credit, refund, discount or other form of compensation. Upon termination of this agreement, you shall immediately discontinue your use of the site and delete all content obtained from it.

Billing and Refund

• 'Ticket' refers to the rights to access content that is associated with. The content that is accessible varies depending on the type of ticket purchased. This will be declared in the ticket service specifications. The ticket service is available and usable as long as GOMTV.net is in service.
• The user may be required to purchase a ticket to use a certain Service.
• 'Season' refers to period of time during which a tournament or otherwise connected series of matches is played.
• A season ticket grants access to the respective season’s content only.
• A yearly ticket grants access to specific content produced in the year the ticket is intended for. The content covered by the ticket is specified in the ticket specifications.
• A monthly subscriptions are non-refundable and are active for a month from the date of purchase and grants access to all SC2 contents produced by GOMTV.net including access to content previously produced in the same year for the duration of the ticket.
• A monthly subscription is active for a month from the date of purchase and grants access to all SC2 contents produced by GOMTV.net including access to content previously produced in the same year for the duration of the ticket.
• A monthly subscription will automatically renew each month on a rolling basis (approximately every 30 days) unless you cancel your monthly subscription in accordance with the third party payment service (e.g PayPal.com). Cancellation will become effective as of the next monthly billing cycle following receipt. When you cancel your monthly subscription, you will be able to access the content up to 1 month from last billing date.
• Every purchase is done through third party payment service (e.g PayPal.com) and does not occur in GOMTV.net.
• Because the Service is offered in multiple time zones, for consistency, a "day" for purposes of these Terms of Use begins at 12:00 a.m. Korean Standard Time and ends at 11:59 p.m. Korean Time of that same calendar day.
• Scheduled games may be cancelled or substituted due to unexpected issues.
• By pre-ordering products, the user is authorizing the Services to charge your account and use the Service (Live and VOD) when 'Season' starts.
• In case a refund is requested and the refund conditions are met, Gretech will refund the purchase price via a third party payment service (e.g. PayPal.com).
• A refund request may be made to support@GOMTV.net within 3 days of ticket purchase with no record of viewing.
• The user is responsible for providing sufficient bandwidth to use the VOD and/or Live Service. The speed to our servers may be tested with our bandwidth checker tool, available here: http://www.gomtv.net/process/speedCheck.gom. Lag issues caused by circumstances on the user’s end are not eligible grounds for a refund.
• The computer and network environment of the user are sole responsibility of the user’s and may affect usage of the VOD and/or Live Service.
• If there are special circumstances in which Gretech determines it is appropriate (e.g. GOMTV VOD and/or Live Service is unavailable for a few days due to technical difficulties), we may provide compensation to affected members.
• The amount and form of such credits, and the decision to provide them, are at Gretech's sole discretion, and the provision of credits in one instance does not entitle anyone to credits in the future under similar or different circumstances.
• Prices for products offered via the services may change at any time, and the services do not provide price protection or refunds in the event of a price reduction or promotional offer.
• Seasons whose Grand Finals have ended over a year ago may be offered to watch free of charge with ads. If content changes from a pay per view service to a free service, users will be notified in advance on the website. Ticket holders will continue to be able to use the service in the same manner as before.
• If you made an in-app purchase in the GOMTV.net GSL mobile application, you may be able to receive a refund from the online store where you made your purchase in accordance with the refund policies of that store.

Duties of the User

• In order to access certain 'Services', you may be required to provide information about yourself (such as identification or contact details) as part of the registration process for the 'Service', or as part of your continued use of the 'Services'. You agree that any registration information you give to 'Gretech' will always be accurate, correct and up to date.
• Contents of www.GOMTV.net may be rated 12+ and in order to use all of the ‘Services’, the user must be at least 12 years old. 'Gretech' is not responsible for the service restriction due to his/her age.
• The user agrees to use the 'Services' only for purposes that are permitted by (a) the Terms of Service and (b) any applicable law, regulation or generally accepted practices or guidelines in the relevant jurisdictions (including any laws regarding the export of data or software to and from the United States or other relevant countries).
• The user agrees not to access (or attempt to access) any of the 'Services' by any means other than through the interface that is provided by 'Gretech', unless he or she has been specifically allowed to do so in a separate agreement with 'Gretech'.
• The user agrees not to participate in activities that interrupt the 'Services' (or servers and networks that are connected to the 'Services'). This includes but is not limited to posting any comments, links or form of communication/expression on GOMTV.net website that might appear offensive or obscene to other users. Failure to fulfill the above duty will result the suspension of your GOMTV.net account. Uploading VODs obtained from GOMTV.net website and re-streaming GOMTV live broadcasts through other websites are not allowed. Failure to fulfill the above duty and other duties as a user mentioned in this section will result in the termination of your GOMTV.net account without any prior notice (no refund will be given even if the user has paid for paid services at the time of termination).
• Unless the user has been specifically permitted to do so in a separate agreement with 'Gretech', the user agrees not to reproduce, distribute, duplicate, copy, sell, trade or resell any of the components of 'Services' for any purpose.
• The user agrees that he or she is solely responsible for (and that 'Gretech' has no responsibility to the user or to any third party for) any breach of the user's obligations under the Terms of Service and for the consequences (including any loss or damage which 'Gretech' may suffer) of any such breach.
• The user cannot use the information related to the copyright and intellectual property right of 'Gretech' or service providers acquired by using the 'Services' offered by 'Gretech' to copy, send, publish, distribute, broadcast and etc or allow a 3rd party to use such information.
• The user agrees and understands that he or she is responsible for maintaining the confidentiality of passwords associated with any account the user uses to access the 'Services'.
• Sharing of passwords to any services, products or the Gretech properties is strictly forbidden. One GOMTV.net account should only be accessed by one user and that user only.
• The user should not create and use more than one account created by him or herself. Gretech will not transfer your ticket purchases from one account to another.
  Exception: SNS account holders may request once to transfer to web account due to suspension of SNS accounts.
• The user agrees that he or she will be solely responsible for all activities that occur under the user's account.
• If you become aware of any unauthorized use of your password or of your account, notify 'Gretech' immediately.
• You are responsible for any costs you incur to access the internet.

Privacy and the User's Personal Information

• For information about the data protection practices of 'Gretech', please read our 'Privacy Policy' provided in the 'Services'. This policy explains how 'Gretech' treats user's personal information, and protects user's privacy, when the user uses the 'Services'.
• The user agrees to the Gretech's use of his or her data in accordance with the 'Privacy Policy'.

Duties of Gretech

• 'Gretech' will do its best to perform the fulfillment of right and duty defined by the Terms of Agreement.
• 'Gretech' will possess a protection system to protect personal information (including credit information) to allow the users to safely use the 'Services' and must notify and uphold the 'Privacy Policy'.
• 'Gretech' will do its best to resolve a user's suggestion or complaint regarding the use of 'Service's if it is regarded as just. 'Gretech' delivers the process or the result about the suggestion or the complaint through the forum or e-mail.
• 'Gretech' will make a compensation based on a reasonable standard if the user has experienced damage even after following the duties defined by the Terms of Service.
• 'Gretech' will do its best to stop the spread of damage (revise, delete, explain) if a third party is damaged by the 'Services'.
• 'Gretech' will do its best to provide related information required by a third party if the third party is damaged by the 'Services' as long as it does not infringe upon others' rights.

Limitation to the User's right to 'Services'

• If the contents submitted, posted or displayed by the user on or through the 'Services' fall under one of the categories below, 'Gretech' can modify or remove the contents without the user's agreement. If the content is illegal or violates any laws, the content will be immediately deleted and the IP address of the uploader will be reported to the authorities.
  • If the user has entered false information at the time of registration.
  • If the user disrupts others' use of 'Services'
  • If the user has acted in ways that are prohibited by the Terms or has caused a damage (defamation, interruption of task, property damage and etc.) to a third party.
  • If the user illegally uses others' information
  • If the user has submitted, posted, or displayed contents that contain obscenity, racist, or violent materials on or through the 'Services'.
  • Regarding paid 'Services', if the user has not made a necessary payment, paid with a wrong method, or received a refund.
  • If the user performs any other activities that can be deemed illegal or wrongful.
• If the contents submitted, posted or displayed by the user on or through the 'Services' fall under one of the categories below, 'Gretech' can modify or remove the contents without the user's agreement. If the content is illegal or violates any laws, the content will be immediately deleted and the IP address of the uploader will be reported to the authorities. Violating these terms will result in termination of your ability to upload further contents.
  • If it is found that the information is false.
  • If it contains contents that defames or interrupts the task of 'Gretech' or a third party.
  • If it contains obscenity, racist, or violent materials.
  • If it contains spoilers.
  • If it is pornographic or offensive in nature (including nudity, violence, sexual acts, or sexually provocative images.)
  • Any other cases that can be reasonably deemed as inappropriate.
• The user agrees that 'Gretech' has the right to make inspections and reviews on, prevent duplication (flag) of, and filter, modify, reject, or remove contents submitted, posted, or displayed on and through the 'Services' by the user to prevent the contents from falling under the above categories 1) and 2).
• The user acknowledges that while using the 'Services' he or she can be exposed to contents that can cause disgust, are rude, or offensive and understands that he or she can take the burden of risks resulting from such contents.

Termination

IN THE EVENT THAT THE USER TERMINATE HIS/HER ACCOUNT WITH WWW.GOMTV.NET OR BREACH THIS TERMS AND CONDITIONS, THE USER WILL FORFEIT HIS/HER RIGHT TO ANY AND ALL PAYMENTS HE/SHE MAY HAVE MADE. THE USER AGREES AND ACKNOWLEDGES THAT HE/SHE IS NOT ENTITLED TO ANY REFUND FOR ANY AMONTS WHICH PRE-PAID ON BEHALF OF THE ACCOUNT PRIOR TO ANY TERMINATION OF THIS AGREEMENT.

Advertisement

• Parts of the 'Services' are supported by advertising revenue and may display advertisements or promotions. These advertisements may be targeted to the content of information stored on the 'Services', questions made through the 'Services' or other information.
• The manner, mode and extent of advertising by 'Gretech' on the 'Services' are subject to change without specific notice to the user.
• As compensation to the access and use of the 'Services' offered by 'Gretech', the user agrees that 'Gretech' may place such advertising on the 'Services'.
• The user agrees that 'Gretech' can post advertisements on software screen, homepage, e-mail and etc. regarding the offer of 'Services'. Users who have agreed to receive advertisement e-mail can choose not to receive them from 'Gretech'.

Limitation of Liability and Warranty

• 'Gretech' will not be responsible for the 'Services' that could not be provided or delivered due to an emergence of war, natural disaster, national emergency or any other unavoidable reasons that might deter 'Gretech' from providing normal 'Services'.
• 'Gretech' is not liable for any losses related to the 'Services' resulting from the abnormal offer of services provided by Internet Service providers or electricity service.
• 'Gretech' is not liable for any damage resulting from pre-notified repair, replacement, regular maintenance, construction related to 'Services' and other unavoidable reasons.
• 'Gretech' is not responsible for the validity and accuracy of the information, data and facts provided by the user related to the 'Services'.
• 'Gretech' is not responsible for problems resulting from the computer environment of the user or network environment that are not the faults of 'Gretech'.
• 'Gretech' is not responsible for conflicts based on the 'Services' between the users or the user and a third party.
• 'Gretech' is not responsible for the unavailability of the 'Services' use during the maintenance period due to the pre-notified maintenance of the 'Service's conducted to provide stable 'Services'.
• The user fully acknowledges and agrees that the risk and burden of using the 'Services' lies entirely on the user and the 'Services’ are offered 'as is' and 'are provided to use'.
• All the data acquired or downloaded through the use of 'Services' is acquired at the user's own risk and burden, and the user is liable for any loss or damage to the device or data resulting from the download of such data.
• 'Gretech' denies any warranty or term for the information, advice, dictation that are not written in the 'Agreement' but acquired (implied or not implied) through the use of 'Services'.

General Legal Terms

• As a general rule, if a lawsuit has been made against 'Gretech', it will be tried at a competent court that has the jurisdiction over the location 'Gretech' headquarters is in.
• If some countries do not acknowledge the jurisdiction of the competent court governing over the location of 'Gretech' headquarters, only the legal limits set by the user's country will be applied to the user and the responsibility of 'Gretech' will be limited to the maximum bounds allowed by the law of the related country. However, in any cases, 'Gretech' can apply for a preservative measure or a similar form of emergent legal relief measure in all countries.
• When using the 'Services', the user may use a service or download a piece of software, or purchase services, which are provided by third party. Use of these other services, software or goods may be subject to separate terms between you and the company or person concerned. If so, the Terms of Service do not affect your legal relationship with these other companies or individuals.
• If any court of law, having the jurisdiction to decide on this matter, rules that any provision of these Terms of Service is invalid, then that provision will be removed from the Terms of Service without affecting the rest of the Terms of Service. The remaining provisions of the Terms of Service will continue to be valid and enforceable.

Gretech Gathers Information About Users

Users of the site's discussion forum and VOD/Live service must register for the service (free of charge) in order to post comments and watch videos, although they needn't register to visit the site.
During registration process the user is required to supply a username, country, password, and email address.

Use of Information

GOMTV.net may use any information voluntarily given by our users to enhance their experience in our network of sites, whether to provide interactive or personalized elements on the sites or to better prepare future content based on the interests of our users. As stated above, we use information that users voluntarily provide in order to enable users to watch VOD/Live shows and participate in polls, surveys, and discussion forums. This helps us continue to build a better service for you.

Children

Consistent with the Federal Children's Online Privacy Protection Act of 1998 (COPPA), we will never knowingly request personally identifiable information from anyone under the age of 13 without requesting parental consent.

Security

Ticket Policy

• Refund for regular tickets is possible within 3 days of ticket purchase, only if you do not have any history of using the VOD or HQ Live stream service. Monthly subscription tickets can only be cancelled, not refunded.
• The subscription ticket policy is in effect for 2012 and is subject to change and/or cancellation.
• Besides the case of a problem related with the service provision of GOMTV.net, the transaction fee will be deducted from the amount of the refund given.
• For subscription tickets: You gain access to the content for the duration of the ticket. That means that if you manually cancel your subscription at some point, you will lose access to the content. In the case of regular season tickets or yearly tickets, you will gain permanent access to the VODs once you purchase the ticket.
• When cancelling a premium subscription you will not able to purchase a premium subscription ticket again for one month. You may cancel the subscription directly at your PayPal account.

Common Policy

• Refund requests will usually be processed within 5 days after the request has been made.
• The live broadcast schedule may change due to various unforeseeable reasons. This may not used as grounds for a refund request.
• Ill-mannered behavior such as trying to abuse the refund system is prohibited and will be penalized by denying refunds and future purchases.
• Live broadcast or VOD service problems due to equipment malfunction caused by natural disasters are not eligible grounds for a refund request.
• Upon receiving a refund due to our services not being fully available in your region, further purchases of our premium services may be restricted until our service issues are fully resolved in your region.
